Apartment Sublease

The usual method of renting an apartment would be by renting from the owner or landlord; but in an apartment sublease, renting is actually arranged through a lessee rather than from the usual parties. An apartment sublease is a type of lease where a lessee already involved in a lease takes on a third party, creating a new lease underneath, the sublease. In essence, the original lessee is both renting and renting out the same apartment. For terms of this sublease, the original lessee becomes a sublessor and the third party becomes a sublessee. When the sublease is created, it must also be accompanied by sublease agreement, a written or oral document that defines the relationship between sublessee and sublessor. The terms of this agreement must be confirmed as legal under the terms of the original lease, especially considering that many leases are created with a sublease clause. Additionally, an apartment sublease is subject to the landlord tenant statutes that govern other leases as well, including tenants rights and the rights of the landlord.
