For landlords, making an eviction legal must follow several important steps. Currently, there are many laws in place to protect tenants from being evicted unlawfully or without cause. As a result, in order to evict a tenant, landlords must follow a strict legal process that prevents these unlawful evictions. According to the laws, there must be a violation in the lease committed by the tenant for the eviction to have any legal bearing. Therefore, it is important that landlord first identifies a violation in the lease, which can include things such as nonpayment of rent, causing damage, or staying beyond the term of the lease. After identifying a violation, the next step requires that tenants are provided with adequate notice. When the period of notice has passed, the case can then be filed with the court, resulting in a hearing that will determine a judgment. If the judge does determine the eviction legal, the landlord has permission to remove the landlord and their possession from the property.
