For an Illinois eviction to occur, there is a very unique legal process that landlords must follow. Although dealing with tenants who have faulted on their lease can be difficult, landlords are never at liberty to remove tenants by their own means. In an effort to protect both landlord and tenant, the legal eviction process involves steps that honor the needs of each party. To begin an Illinois eviction, the landlord must have identified a violation in lease or otherwise unlawful act performed by the tenant. Provided that that a violation has occurred, the landlord will need to an an eviction notice, linked with a time during which the tenant must leave or correct the violation. If the tenant refuses to pay up or leave, the final step of the eviction process will ensue ﾖ court action. The landlord can file the case with a local court and then receive a judgment after a hearing takes place.
