Landlord rights in Texas include the right to assert a lien on a tenant's property for nonpayment of rent. A landlord's right to assert a lien must be expressly stated in the lease contract in underlined or bold print. If a lease contains a lien provision, a landlord may be able to legally enter a tenant's apartment and take their property until rent is paid. Certain types of property are excluded and cannot be legally taken, such as clothing, family pictures, and medicine. If a tenant does not pay the owed rent, a landlord may then be able to sell the tenant's property. If a tenant abandons a property, Texas law gives landlords the right to remove all property from the premises. Texas is a state that has fewer regulatory laws than many other U.S. States, therefore specific tenant and landlord rights are often not provided under Texas laws. For example, there are no regulatory limits in Texas regarding how much a landlord may charge for a security deposit, therefore landlords can technically set their own prices when it comes to security deposits.
