Can I evict a tenant for nonpayment of rent in California?

I am a landlord and my tenant has been late on paying rent 3 months out of the past year, and his 4th late payment is coming up. Is this ground’s to evict a tenant in California? What is the eviction procedure?

In California, a landlord may evict a tenant for nonpayment of rent. If your tenant fails to pay rent on time this month you may serve a Three Day Notice to Pay Rent or Quit demanding that the tenant pay the rent owed (plus applicable late fees) or else face an eviction action.   

Additionally, it is possible for a landlord to terminate a lease agreement if the tenant violates the lease agreement or becomes a nuisance to other tenants. The laws governing the amount of time a landlord has to give a tenant to vacate a rental property vary depending on the amount of time the tenant has occupied the property and the landlord’s reason for evicting the tenant. Because the laws are so fluid depending on the exact circumstances of the eviction and because under California law a tenant can recover his or her damages from the landlord if the eviction is deemed illegal, it is highly advisable to seek the advice of an attorney who is familiar with landlord/tenant law.
