Legislation To Extend Tenant Eviction Notice To 60 Days

Governor Schwarzenegger today announced the signing of AB 1169 by Assemblymember Alberto Torrico (D-Fremont) that requires landlords to give 60 days notice before requiring an evicted tenant to move out.
“Being asked to move involuntarily is never easy, and moving is especially difficult for the elderly and persons with disabilities,” said Governor Schwarzenegger. “This bill will help soften the blow by giving tenants time to deal with the financial pressures of moving. I believe AB 1169 strikes a reasonable balance between the needs of tenants and those of property owners.”
AB 1169 requires landlords to give 60 days notice before terminating the lease of a tenant who has lived in a dwelling for one year or longer, or 30 days notice for a tenant who has resided in the dwelling for less than one year. AB 1169 will remain in effect until 2010.
