Most states require that a landlord give their tenant reasonable notice of entry before entering the property. 24 hrs notice is considered reasonable unless there is a property emergency such as a fire or plumbing leak.  Your landlord cannot spy on you or harass you. This is considered illegal. The law gives a tenant right to privacy and protection against unlawful landlord entry. A landlord illegal entry is considered a breach of your lease and you may be entitled to injunctive relief or termination of your lease.

Failing to Let Landlord Enter Premises

On the other hand, if you chose not let your landlord enter the premises after you have been given reasonable notice so that the landlord can make repairs or other legal actions defined in your lease such as showing the property, you are in violation of your lease terms and your landlord may be able to terminate your lease and evict you if you do not vacate the premises in a timely manner. Always read your lease carefully before signing it so that you understand your rights and responsibilities and the landlord’s rights and responsibilities.

Unauthorized Landlord Entry Legal Help

Since landlord/tenant laws are complex, it is recommended that you consult with a real estate attorney that specializes in landlord/tenant laws.  If you suspect your landlord of unlawful landlord entry, an attorney is the best person to advise you of your legal rights and obligations. An attorney can represent you in court in a legal action against your landlord.
